NEW YORK — The Select Sector SPDR Trust, which offers a family of exchange-traded
funds (ETFs) that divide the S&P 500 into nine individual sector funds,
has filed suit against PowerShares Exchange-Traded Fund Trust II,
INVESCO PowerShares Capital Management, LLC, and INVESCO Distributors,
Inc. under Section 43 of the Federal Trademark Act, and common law of
the State of Texas.
At the core of Select Sector SPDRs complaint is PowerShares use of
ticker symbols for the nine sector ETFs it launched in April, which are
based on the S&P 600. These new symbols differ by just one letter, an
S appended to the end of the same symbols used since 1998 by Select
Sector SPDRs for precisely the same sectors.
This is a deliberate and unconscionable act on the part of PowerShares
to confuse both institutional and retail investors, said Dan Dolan,
Director of Wealth Management Strategies for the Select Sector SPDR
Trust. At a time when transparency in finance and investing has never
been more necessary or in demand by regulators, legislators, and the
investing public, PowerShares has succeeded in casting an unfortunate
shadow on Wall Streets efforts to eliminate financial opacity.
The Complaint notes that the Select Sector SPDR Trust has invested
substantial time, creative effort and millions of dollars developing an
association in the mind of investors between the particular symbols
under which the Trust’s ETFs are offered and the financial product the
symbol actually represents.
Dolan noted that the symbols of 101 out of 102 ETFs previously launched
by PowerShares start with P. The sector funds in question are the only
products in PowerShares ETF family that begin with an X, followed by
the same two letters as Select Sector SPDRs, with only an S appended
at the end, for example:

School lunches are notoriously bad. Mystery meat, fake cheese, and a lack of fresh fruit and vegetables are only part of the problem; with high-calorie sodas and vending machine options increasing the calorie intake of our children, the whole system is feeding our children in a way that is nutritionally inferior. While many children balk at brown-bagging it or-heaven forbid- carrying a lunchbox, it is the only way to ensure that they eat healthy, balanced food. But the tide may be changing.
With the White House advocating with the Healthy Food Financing Initiative, First Lady Michele Obama taking the message to the streets and to food manufacturers, and Jamie Oliver’s Food Revolution gaining ground, the focus on school lunches has probably never seen so much press. Combined with the alarming rate of obesity amongst our youth, and it was bound to happen that someone in Congress would lead a charge to shake things up in school cafeteria’s around the country.
A long time coming, Senator Blanche Lincoln, who chairs the Agriculture Committee, has put forth a ten-year, $4.5 billion increase in funding for school lunch and nutrition programs. While this stops short of President Obama’s $1 million/year request, and that of food advocates such as Alice Waters and Ann Cooper, it will provide much-needed upgrading of food standards in our schools.
“This proposal is a monumental step forward as we work to end childhood hunger and address the epidemic of childhood obesity in the United States,” Lincoln said in unveiling her bill.
The bill will not only feed more children who cannot afford a mid-day meal but make it easier to attain eligibility for free meals. In addition, it will include provisions for allowing the Agriculture Department to set nutrition standards for all food sold at schools, and could ban high-sugar sodas and junk food from vending machines.
Currently, the school lunch program serves over 32 million children, with over 60 percent being free or reduced in cost.
In many poor urban areas and low-income rural communities, the lunch program is a significant portion of a student’s daily calories and nutrition soda vending machines

INJURY-HIT South Wales Scorpions face a test of their squad strength at Rochdale on Sunday.
The Neath-based side will not have played for two weeks when they make the trip to Spotland.
But they go into the clash in buoyant mood after hitting the 70- point mark in their hammering of Gateshead Thunder in their last outing.
“The players are fresh and ready to give a good account of themselves in the last quarter of the season,” said head coach Anthony Seibold.
“Rochdale have put many teams to the sword at Spotland this season and have racked up some big scores.
“We know they have many threats including Phil Wood and Wayne English among others, and we are working hard this week to get a good performance.
“There is some pressure on Rochdale at present as one of the teams above us and one of the teams touted only a few weeks ago as potential promotion candidates, and we know they have prepared well.
“It will be tough for us with many players still under injury clouds or unavailable this weekend, but we are confident that if we prepare well and look after our own individual performance, that collectively we can continue to improve.”
The Scorpions have just five matches to play in what has been an encouraging first season in Co-Operative Championship 1. The end-of- season schedule features tough trips to Rochdale, Oldham and Hunslet, with games at The Gnoll against Doncaster and York.
But Seibold is determined to end the campaign on a high note.
“We have nothing to lose as we go into the last five games,” he added. “We are excited about what we have done in achieving our original goal of five wins, but more importantly we are excited about the last five games and what we can do if we work hard.
“It is going to be tough, but we continue to improve and we continue to fight hard in games, as can be seen by the amount of bonus points we have picked up in our losses and the manner in which we have won games.
“That is all I can ask from a team thrown together on February 1.”
